It doesn’t matter whether or not you serve prison time for sexual assault. If you are convicted, you WILL be required to comply with sex offender registration laws in Florida and the US. These laws require you to update your address with the registry for the rest of your life.
After serving a prison sentence, a judge can sentence you to sex offender probation for up to 15 years. If the judge places you on this type of probation, you will also have to comply with the following restrictions:
- You cannot live within 1,000 feet of schools, parks or other locations where children gather
- You cannot work or volunteer at any organization where children gather (including libraries, day care centers, pet shops, schools and the like)
- You may be subject to warrantless searches at your probation officer’s discretion
- You may be required to participate in a mandatory outpatient sexual offender treatment program at your own expense
A rape conviction in Florida is not eligible for expungement, so it remains on your criminal record permanently. In addition to ongoing social stigma, you may face professional sanctions after a conviction, or simply be unable to legally continue in your current occupation. Furthermore, if you do not keep your records updated with the offender registry, you may face additional criminal penalties.
